Mattress Warranty
Mattress 10-Year Limited Warranty (Essential Mattress, Basic Mattress)
1. Scope of Coverage
Lifement™ warrants its mattresses to be free from defects in materials and workmanship under normal use conditions for a period of ten (10) years from the original purchase date. Warranty coverage begins after the expiration of the authorized dealer’s return period and is valid solely for the original purchaser, who must retain the original proof of purchase.
2. Covered Manufacturing Defects
Lifement™, at its discretion, will repair or replace mattresses with qualifying manufacturing defects. The warranty covers:
- Excessive Sagging: Visible and permanent sagging greater than 1.5 inches (measured without weight) that affects mattress support, unrelated to foundation sagging.
- Structural Integrity: Failure in workmanship or materials affecting the mattress’s core structure or support.
3. Proper Use Conditions
To qualify for warranty service, the mattress must be used on a suitable, supportive foundation. Use of inadequate foundations, platforms, or bases will void the warranty if they result in product damage. Indentations of less than 1.5 inches are considered normal wear and are excluded from warranty coverage. Lifement™ recommends using a stain-resistant pad to protect the mattress.
4. Exclusions and Limitations of Liability
This warranty does not cover:
- Normal Wear and Tear: Gradual softening, impressions, or minor firmness changes from regular use.
- Comfort Preferences: Personal preferences, sagging under 1.5 inches, or changes in firmness perception.
- Neglect or Misuse: Damage from neglect, abuse, burns, cuts, moisture, stains, or use without a suitable foundation.
- Non-Defective Parts: Minor cosmetic imperfections that do not affect structural integrity.
- Unauthorized Modifications: Removal of the Law Tag, unauthorized repairs, alterations, or modifications.
- Use of Heating Devices: Heating pads, electric blankets, or similar devices used with memory foam mattresses.
- Transportation Costs: Customers are responsible for all shipping, handling, and transportation fees related to warranty claims.
5. Warranty Validity and Exclusive Remedy
This warranty is valid only for the original purchaser, with proof of purchase required in the form of the original receipt from an authorized dealer. Removal or tampering with the Law Tag, which serves as a federally mandated identifier, voids this warranty. Upon verification of a qualifying defect within the warranty period, Lifement™ will either repair, replace, or offer a prorated refund based on the mattress’s age, at its sole discretion. Only the defective part is eligible for repair or replacement.
In year one, the customer may receive a full replacement or repair at no product cost, excluding transportation. From the second year onward, Lifement™ may offer limited or prorated support depending on the age and condition of the mattress. Generally, the older the mattress, the higher the percentage the customer may need to contribute toward a replacement. For example, in years two through four, Lifement™ may offer partial support, and in years five through ten, a prorated refund or discounted replacement may be provided at increasing cost to the customer.
6. Customer Responsibilities and Warranty Claim Process
To initiate a warranty claim, customers must:
- Provide Proof of Purchase: Submit the original purchase receipt.
- Supply Visual Evidence: Provide clear photos or videos showing the defect (e.g., sagging greater than 1.5 inches). Proof of an adequate foundation may also be required.
- Cover Transportation Costs: Assume all costs associated with shipping, handling, and transportation related to warranty claims.
- Ensure Proper Product Care: Use a supportive base and protect the mattress from stains, moisture, and damage.
7. Disclaimer of Warranties and Limitation of Liability
This limited warranty represents the complete warranty provided by Lifement™, excluding all other warranties, expressed or implied. Lifement™ disclaims any implied warranties of merchantability or fitness for a particular purpose, except where limitations on such warranties are legally prohibited. In states where limitations on implied warranties are restricted, the duration of such implied warranties is limited to the warranty term.
Under no circumstances will Lifement™ be liable for incidental, consequential, or special damages arising from the use of the mattress, including but not limited to loss of use, inconvenience, or any costs related to mattress removal, repair, or replacement. Certain jurisdictions do not permit the exclusion of incidental or consequential damages, so these limitations may not apply to all customers.
8. Governing Law and Additional Rights
This warranty is governed by the laws of the state where the mattress was purchased, and any disputes arising under this warranty shall be resolved in accordance with those laws. This warranty grants specific legal rights to the purchaser, and additional rights may vary by state. If any provision of this warranty is found unenforceable, the remaining provisions shall remain in full effect.
